The Commission of Sanctions and Complaints reviewed the complaint no.54, dated 08.05.2023, filed by the Socialist Party of Albania, with object “Appeal to the Decision no.455, dated 06.05.2023 “On administrative review of complaint no. 386 by KRIIK for posting of propaganda materials in violation of the law by electoral subject ” Socialist Party of Albania” in the national axis Tirana Lushnje”, of the State Election Commissioner.
At the end of the review, CSC partially accepted the request and decided to amend point 1 of the Decision no.455, dated 06.05.2023, of the SEC, “On administrative review of the complaint no. 386 by KRIIK on posting of propaganda materials in violation of the law by the “Socialist Party of Albania” in the national road axis Tirana Lushnje, respectively in the municipalities of Tiranë, Durrës, Rrogozhinë, Kavajë and Lushnjë, which do not contain the note ” produced under the legal responsibility of the Socialist Party of Albania”.
Today, the complaint no. 55, 08.05.2023 was reviewed, filed by ” Together we Win” Coalition with object:
1)Appeal to decision no. 452, dated 06.05.2023 “On evaluation of reports of election campaign monitors for March 7 to May 2, 2023 monitoring period “, of the State Election Commissioner;
2) Appeal to decision no. 456, dated 06.05.2023 “On administrative review of complaint no. 387 filed by the Socialist Party of Albania, on the removal of election materials placed in violation of the law by the “Together We Win” Coalition, for local government elections of May 14, 2023″, of the State Election Commissioner;
3)The partial amendment of SEC decision no. 452, dated 06.05.2023, deciding:
a) Dismissal of administrative investigation of the claim to close down the election offices of the subject “Together We Win” Coalition ” in the Municipality of Tirana, located in Rr. “Artan Lenja” Rr “Milto Tututlani”; Rr. “Margarita Tutulani”, in Elbasan municipality, located near “Aleksandër Xhuvani” University;
b) Dismissal of the administrative investigation of the claim to close down the office of Democratic Party in “Nasip Pallvo” street, near the Artistic Lycee, as this office does not belong to electoral subject DP registered in these elections by the CEC, but it belongs to the political subject that is identified with “Together We Win” coalition and it is not an electoral office in the meaning of the Electoral Code, but is the permanent political office/headquarters of DP, branch no. 2 Tirana.
c) Dismissal of administrative investigation of the claim to remove propaganda materials in Durrës and Tirana Municipalities, of the subject “Together we Win” coalition, on light poles, on “Veli Dedi” street, Tirana Municipality.
4) Amendment of SEC decision no. 256, dated 06.05.2023, deciding: Dismissal of administrative investigation on the request for immediate removal of propaganda material on the facade of the building of the Albanian Post Office in Kavajë, belonging to the “Together We Win” Coalition.
At the end of the review, CSC decided to partially accept point 3, letter b) of the appeal, revoking the Commissioner’s decision on this point, and rejected all other points of the appeal.
In addition, the complaint no. 56, dated 10.05.2023, was reviewed today, filed by the complainant Socialist Party, with object: “Opposition to decision no. 472, dated 09.05.2023 “On the administrative review of the complaint no. 392 filed by KRIIK for posting of propaganda materials in violation of the law by the electoral subject “Socialist Party of Albania” on the national road axis Elbasan – Librazhd, for local government elections of May 14, 2023″, of the State Election Commissioner”.
At the end of the examination, CSC decided to drop the administrative investigation of the complaint no. 56.
