The Commission of Sanctions and Complaints reviewed the complaint no. 85, dated 24.05.2023, filed by complainant, electoral subject “Together we Win” Coalition, with object “Appeal to Decision no. 539, dated 20.05.2023 “On approval of Aggregate Table of Results for the election of Mayor and Municipal Council in the electoral zone Elbasan Municipality, for local government elections of May 14, 2023. Computer expertise of each device equipped with a server for storing electronic data. This should be done by foreign experts, who are independent from state institutions or the Central Election Commission. For this, it is necessary that the equipment be stored in suitable conditions in the current state in order to avoid tampering with, by unauthorized persons and protect it from atmospheric agents. Comparison of the electronic election result with the physical result (ballots found in the box), for each voting center. For this, it is required a process as transparent and comprehensive as possible;

Inspection of external cameras  and those used inside the voting centers in order to identify all unauthorized persons,  or those who are part of the local and central administration at the specialist or managerial level, who have been present in the voting centers all time, to identify unsigned relevant declarations for the voters that have been accompanied in the voting center, identify voting by the PEVN operators,  or by the commissioners on behalf of the voters. Comparison of voter codes with the list of voters for each VC in Elbasan Municipality, regarding voters’ identification device (PED); Recounting and Revaluation of votes in all voting centers of the electoral unit, Elbasan Municipality and approval of Aggregate Table for Elbasan Municipality electoral zone, including the result obtained from the recounting and revaluation of votes; Invalidity of elections held in the electoral zone Elbasan Municipality; finally, after the above actions have been carried out and there is institutional proof that this is not the vote of the citizens”.

CSC partially accepted the request of the complaining party and decided to recount and re-evaluate the ballots for mayor in VCs no. 2373/01, no. 2481/01 and no. 2483/00, on Monday, 05.06.2023, at 12:00. CSC ordered the CEC Administration to put at the complainant’s disposal, the records and protocol book of CEAZ no. 47, to give the complainant access to the materials. CSC, with a majority of votes decided to give time to the complaining subject, until Monday, 05.06.2023, at 12:00, to see the video recordings of the VCs.

 CSC reviewed the complaint no. 74, dated 22.05.2023, filed by the complainant Mr. Lefter Maliqi, with object “We request the change of Decision No. 101, dated 16.05.2023 of Election Administration Zone No. 64 Kuçove Municipality, Berat Region, “On Approval of the Aggregate Table of Results for the Election of Kuçove Mayor”

We request the recount and reevaluation of ballots in CEAZ no.64, in all voting Centers, including in it the results from the recount and reevaluation of ballots for the VCs listed in the table. We request the invalidity of decision No. 101, dated 16.05.2023, “On Approval of the Aggregate Table of Results for the Election of the Mayor of Kuçova”. We request the invalidity of the decision of the CEC where the secretary of CEAZ, No. 64 Kuçove, Romeo Arizi, was appointed. We request the invalidity of the decision of CEAZ No. 64, Kuçove, Berat Region on postponement of the counting of ballots, from 11:00 a.m. to 12:30 p.m. We request the partial invalidity of the ballot for Candidates for Mayor of Kuçova Municipality, for the part where the candidacy for Kuçovo Municipality, Berat District, Kreshnik Hajdari is listed. The invalidity of juridical action, decriminalization form, in the name of Kreshnik Hajdari, submitted to the CEC, pursuant to the law, no. 138/2015 “On guaranteeing the integrity of persons who are elected, appointed or exercise public functions” and the complaint no. 67, dated 20.05.2023, filed by appellant, electoral subject “Together we Win” Coalition”, with object “Appeal to Decision no. 101, date 16.05.2023 of CEAZ No. 64, Kuçova Municipality, Berat Region “On approval of the Aggregate table of results for the election of Kuçova Mayor”.

CSC accepted the request filed by the complainant Mr. Lefter Maliqi to suspend the review of the complaint until the final judgment by the Electoral College of his appeal against the decision no. 136 of CSC, dated 22.05.2023.

The Commission of Sanctions and Complaints continued the review of complaint no.81, dated 23.05.2023, filed by complainant, electoral subject “Together we Win” Coalition, with object “Appeal to Decision no. 536, dated 20.05.2023 “On approval of Aggregate Table of Results for the election of Mayor and Municipal Council, in the electoral zone Kamez Municipality, for local government elections of May 14, 2023. Computer expertise of each device equipped with a server for storing electronic data. This should be done by foreign experts, who are independent from state institutions or the Central Election Commission. For this, it is necessary that the equipment be stored in suitable conditions in the current state in order to avoid tampering with, by unauthorized persons and protect it from atmospheric agents. Comparison of voter codes with the list of voters for each VC in Kamëz Municipality, in relation to the voter identification device (PED); Recounting and Revaluation of votes in all voting centers of the electoral unit, Kamëz Municipality and approval of the aggregate table for the Kamëz Municipality electoral zone, including in it the result obtained from the recounting and revaluation of votes; Invalidity of the elections held in the Kamez Municipality electoral area; as well as recently, after the above actions have been carried out and you have institutional evidence that this is not the vote of the citizens, we request from you: The re-run of elections for the Mayor of Kamez Municipality and Kamez Municipality Council” and no. 86, dated 25.05.2023, filed by the electoral subject Legality Movement Party, with the object “Request of  declaration of invalidity of elections in VC no. 1575, VC no. 1597 etc., Kamez municipality. Appeal to the decision of CEAZ/SEC no. 356, dated 20.05.2023 “On approval of the Aggregate Table of Results for the Election of  Kamez Municipality Council”.

After the inspection of ballots of two voting centers no. 1575/00 and 1597/02, it resulted that the data from the recount match the result of the electronic system from the electronic voting and counting equipment (PEVN). CSC assessed these two ballot boxes as regular, deciding to include them in the Aggregate Table of Results for the elections for Mayor of Kamez Municipality and Kamez Municipality Council.

CSC decided to postpone the hearing on 06.06.2023, at 12:30, to review the evidence submitted by the appellants and admitted  by CSC.
