CSC rejects the appeals of the counters requesting the abrogation of the criminal reports made by the SEC after the post-election verification.

Today, the Appeals and Sanctions Commission reviewed the appeal request no. 76 filed to CEC on 31.12.2021, with the object “Objection to the decision of the SEC, no. 470, dated 03.12.2021, “On the approval of the reports on the key findings of the post-election verification process of ballot papers and electronic counting (PEVN) used for the elections of 25 April 2021”. The complaint was filed by 4 members of a counting team.

At the end of the preliminary review, CSC decided to partially accept the request of the members of the counting team regarding the first 5 points of the complaint and consider for review in public session on 12.01.2021 at 12:00.

Meanwhile, CSC decided not to accept point 6 of the appeal, for the abrogation of point 4 of decision no. 470 of the SEC, regarding the criminal report against the members of the counting team, on the grounds that the criminal report is a legal obligation of the State Election Commissioner, an obligation which derives from Article 281 of the Code of Criminal Procedure and as such no administrative decision needs to be taken on this issue. CSC estimates that the criminal report has already been forwarded to the competent bodies, which makes this appeal request without an object.

Also, the Appeals and Sanctions Commission reviewed the elements of the appeal request no. 01, dated 05.01.2022 with the object “Objection to the decision of the SEC, no. 470, dated 03.12.2021, “On the approval of the reports on the key findings of the post-election verification process of ballot papers and electronic counting (PEVN) used for the elections of 25 April 2021” and the repeal of point 4 thereof.

CSC decided not to accept the appeal, arguing that the criminal report is a legal obligation of the State Election Commissioner, an obligation which derives from Article 281 of the Code of Criminal Procedure and as such it is not necessary to take an administrative decision on this issue. CSC estimates that the criminal report has already been forwarded to the competent bodies, which makes this appeal request without an object.
