Today, the Complaints and Sanctions Commission concluded the review of complaint no. 81, dated 23.05.2023, filed by “Together We Win” Coalition, with the object: “Appeal to decision no. 536, dated 20.05.2023 “On approval of the Aggregate Table of Results for election of Mayor and the Municipal Council, in election zone Kamëz Municipality, for local government elections of May 14, 2023”; Computer expertise of any electronic device that is equipped with a server for storing electronic data. This should be carried out by foreign experts independent from state institutions or Central Election Commission. For this, it is necessary that the equipment be stored in suitable conditions in the current state in order to avoid tampering with, by unauthorized persons and protect it from atmospheric agents; Comparison of electronic result of the elections with the physical result (ballots found in box), for each voting center. For this, a process as transparent and comprehensive as possible is required; Examination of the external cameras and those used inside the voting centers in order to identify all unauthorized persons or those part of the local and central administration in specialist or manager level, who were present the whole time in the voting centers, the evidence of relevant unsigned statements for the voters who were assisted, the evidence of the voting by the operators of the PEVN, the evidence of commissioners’ voting on behalf of the voters; Comparison of voter codes with the list of voters for each VC in Kamëz Municipality, in relation to the voter identification device (PED); Recounting and re-evaluation of votes in all voting centers of the electoral unit, Kamëz Municipality and approval of the aggregate table of results for Kamëz Municipality electoral zone, including the result of the recount and re-evaluation of votes; Invalidity of elections held in the electoral area Kamëz Municipality; finally, after the above actions are taken and after and after you institutionally judge that this is not the vote of the citizens, we request from you: Re-run of elections for the Mayor of Kamez municipality and Kamez Municipal Council” and request no. 86, dated 25.05.2023, filed by the Legality Movement Party, with the object: “Request for the declaration of invalidity of the elections in VC no. 1575, VC no. 1597 etc., Kamez municipality; Appeal of the decision no. 356, dated 20.05.2023 of the SEC/CEAZ “On the approval of the Aggregate Table of Results for the Election of the Kamez Municipality Council”.
With a majority of votes, CES decided to dismiss the complaint no. 81, and uphold the complaint no. 86, changing the decision no. 536, dated 20.05.2023 by the Commissioner “On approval of the Aggregate Table of Results for the election of Mayor and Kamez Municipality Council, for May 14, 2023 local government elections” according to the Aggregate Table approved by the decision interim of CSC, dated 01.06.2023.
In addition, CSC reviewed the complaint no.85, dated 24.05.2023, filed by “Together we Win” Coalition, with object: “Appeal to Decision no. 539, dated 20.05.2023, “On approval of the Aggregate Table of Results for election of Mayor and the Municipal Council, in election zone Elbasan Municipality, for local government elections of May 14, 2023″;Computer expertise of any electronic device that is equipped with a server for storing electronic data. At the end of the review, CSC announced that the Decision will be ruled on Thursday, on 08.06.2023, at 13.15.
