The Commission of Complaints and Sanctions reviewed the complaints no. 79, dated 23.05.2023, filed by the complainant “Social Democratic Party of Albania” electoral subject, with object “Appeal to State Election Commissioner Decision no. 541, dated 20.02.2023 “On approval of the Aggregate Table of Results for elections for Mayor and Municipal Council, in the electoral zone of Vlora Municipality, for May 14, 2023 local government elections”.
At the end of the review, CSC decided to dismiss the complaint as not grounded on evidence.
In addition, CSC reviewed the complaint no. 80, dated 23.05.2023, filed by the complainant “Together We Win” Coalition electoral subject, with object “Appeal to Decision no. 531, dated 18.05.2023 “On approval of the Aggregate Table of Results for the candidates for mayor of Rrogozhina Municipality and Approval of the new Aggregate Table after the Recounting and Reevaluation of ballots in all the voting centers of the electoral zone Rrogozhina Municipality”.
With a majority of votes, CSC decided to dismiss the request of the complainant for re-evaluation and recount of ballots in all voting centers.
Based on Article 136, item 3 of the Electoral Code, for the administrative review of complaint no. 80, CSC members, Mr. Elvis Cefa and Mr. Ledio Braho requested from the CEC to present as evidence all the ballot boxes of voting centers for the election of Mayor in CEAZ no. 43, Rrogozhina Municipality and to evaluate all ballots. For this reason, the session on the review of complaint no. 80 was adjourned until Monday, on 05.06.2023 at 13:00.
CSC also reviewed the complaint no. 81, dated 23.05.2023, filed by complainant, electoral subject “Together we Win” Coalition, with object “Appeal to Decision no. 536, dated 20.05.2023 “On approval of Aggregate Table of Results for the election of Mayor and Municipal Council, in the electoral zone Kamëz Municipality, for local government elections of May 14, 2023. Computer expertise of each device equipped with a server for storing electronic data. This should be done by foreign experts, who are independent from state institutions or the Central Election Commission. For this, it is necessary that the equipment be stored in suitable conditions in the current state in order to avoid tampering with, by unauthorized persons and protect it from atmospheric agents. Comparison of the electronic election result with the physical result (ballots found in the box), for each voting center. For this, it is required a process as transparent and comprehensive as possible;Inspection of external cameras and those used inside the voting centers in order to identify all unauthorized persons, or those who are part of the local and central administration at the specialist or managerial level, who have been present in the voting centers all time, to identify unsigned relevant declarations for the voters that have been accompanied in the voting center, identify voting by the PEVN operators, or by the commissioners on behalf of the voters. Comparison of voter codes with the list of voters for each VC in Kamëz Municipality, regarding voters’ identification device (PED); Recounting and Revaluation of votes in all voting centers of the electoral unit, Kamëz Municipality and approval of Aggregate Table for the Kamëz Municipality electoral zone, including in it the result obtained from the recounting and revaluation of votes; Invalidity of elections held in the electoral area Kamez Municipality; finally, after the above actions have been carried out and you judge that this is not the vote of the citizens, we request from you: The re-run of elections for Mayor of Kamez Municipality and Kamez Municipality Council” and through complaint no. 86, dated 25.05.2023, filed by National Front Party with the object “Request for declaration of invalidity of elections in VC no. 1575, VC no. 1597 etc., Kamez Municipality; Appeal of Decision of CEAZ/SEC no. 356, dated 20.05.2023 “On approval of the Aggregate Table of Results for the Elections of the Kamez Municipality Council”.
With a majority of votes, CSC decided to set a deadline until Thursday, 01.06.2023 at 5:00 p.m. to “Together We Win” Coalition, to submit the evidence reported in this session.
Regarding the complaint. 86, filed Legality Movement Party, CSC decided that the materials for the two Voting Centers, VC no. 1575/00, VC no. 1597/02 of Kamez municipality to be presented to CSC in order to re-evaluate them.
